Whoever gives and takes away… Is a single entrpreneur still entitled to consumer rights?

Abstract

The article discusses the hitherto practice of modifying (excluding or limiting) the warranty for defects of a thing sold under a contract with a natural person, which contract is directly related to their business activity, when it the content of that contract indicate that it is not of a professional character for that person, in particular arising from their business activity, made available under the provisions of the Act on the Central Register and Information on Business Activities (so-called quasi-entrepreneur or single entrepreneur), and analyses whether, in view of the amendments to the Civil Code and the Consumer Rights Act in force since 1 January 2023, it is still possible to apply this practice.
