Limits of the freedom of speech in a work environment – standards of the European Court of Human Rights

Abstract

One of the utmost purposes of the European Convention of Human Rights is to protect fundamental rights against abusive rules of the authority even in the workplace.

The European Court of Human Rights aims primarily at finding a right balance between the main rule of the employee – loyalty, and fundamental rights – among others the freedom of expression. The aforementioned case-law indicates infringement of those rules by national courts or authorities.
