Abstract
The article discusses an institution of annulment of a legally binding judgement passed by the Supreme Court to General Prosecutor’s request under the extraordinary procedure provided for in Art. 64 of the Supreme Court Act. The authoress presents the issue on historical, systematic, functional and structural grounds. The problems relating to statics and dynamics of the proceedings in a case for annulment of a legally binding judgement under Art. 64 of the Supreme Court Act have been analysed more broadly. The study provides and opportunity to outline not only the hitherto positions of the doctrine and the case law, but also is an attempt to present her own view as to the disputable and controversial issues.
