Termination of a tenancy agreement because of the need to pull down the building

Abstract

This publication concisely presents several legal doubts which arise in connection with demolishing a lived-in building. As a matter of fact, the Act of 21 June 2001 on the protection of tenants’ rights, housing resources of municipalities, and amendments to the Civil Code, provides for legal safeguards for the tenants in case the tenancy agreements are terminated because of demolition (e.g. the entitlement to substitute housing, covering of the moving costs), though the vague wording of the Act requires an extensive commentary. With a view to the fact that pursuant to Art. 32 if on the date preceding the effective date of the Act the tenant paid regulated rent, the obligation to provide that tenant with substitute housing and cover the moving costs rests on the relevant municipality only until 31 December 2015, it is all the more worth having a closer look at the said regulations.
