Abstract

This study deals with the legal analysis of the Google Street View service in the context of protection of personal rights (e.g. right to privacy, image) and copyrights limiting the use and dissemination of third party works. In order to analyze the problem properly in the first place the author presented the views on the rights to image under the applicable laws, including in particular Art. 81 of the Copyright Law and Art. 23 and 24 of the Civil Code. Then, the author discussed the circumstances which exclude protection of the image of the person presented in the context of the possibility of its use in the Google Street View service.
