Abstract

The article discusses the object of trial when the plaintiff files an alternative claim. The main focus is on the scope of preliminary examination of formal defects and fees in case of the eventual claim. According to the authoress, this examination does not include admissibility and effectiveness of filing an alternative claim. The authoress concludes that the concept of litigable claim shall apply also in relation to an alternative claim.
