Abstract

Under judicial enforcement, sale by way of an electronic auction is carried out via an IT system. The article discusses changes in the provisions regulating electronic auction sales introduced by the Act of 9 March 2023 amending the Code of Civil Procedure and certain other acts (Journal of Laws of 2023, item 614), in particular concerning the sale of movables via online auctions, which are also applicable to the sale of real properties the enforcement against which is carried out under the simplified procedure (Art. 1013⁶ § 1), claims (Art. 904¹ § 2) and other property rights (Art. 911⁷ § 4). The key change under this amendment that is applicable to auctions of both movable and immovable properties is the manner of ending an auction, which may be termed dynamic and which consists in delaying the end of an auction until the last bid has been made.
