Abstract
Pursuant to the Act of 9 March 2023 amending theCode of Civil Procedure and certain other acts, the legislator has introduced a new separate procedure with the participation of consumers. The author indicates the need to evaluate the provisions on consumer participation in civil proceedings. Particular attention and approval should be given to the new regulations on territorial jurisdiction of the court in cases with the participation of consumers. However, the new solutions regarding concentration of the process material raise objections. They are not supported by the EU institution of disclosure of evidence, and raise doubts regarding the principle of equality of the parties to civil proceedings.
