Abstract

The publication is devoted to the substitute publication in the Court and Commercial Gazette (Monitor Sądowy i Gospodarczy) of a statement of an adequate content and relevant form in cases for protection of personal interests (Art. 1050 § 4 of the Code of Civil Procedure) introduced by the amendment to the Code of Civil Procedure of 9 March 2023. This solution is intended to end the enforcement proceedings by publishing, at the debtor’s cost, in the Court and Commercial Gazette, an announcement the content and the form of which correspond with the required statement . The article argues that the institution regulated in Art. 1050 § 4 of the Code of Civil Procedure will be commonly applied in the practice of justice. However, this does not mean that it should be positively assessed. The debtor will easily free himself from the obligation to publish an apology on the terms set out in the enforcement order.
