Abstract

Constitutive entries in land and mortgage registers are an exception and are required when a special law so provides. Making a constitutive entry in a land and mortgage register is a necessary prerequisite for the creation, change or transfer of a right.This means that in our legislation real estate is traded regardless of the entry in a land and mortgage register. This problem concerns not only transfer of ownership of real estate, but also establishment of certain limited rights in rem.
