Abstract

The article provides an overview of problems concerning the participation of foreign entities other than natural persons in civil proceedings before a Polish court. The analysis concerns such issues as performing procedural acts, identifying the law applicable to the assessment of the capability to act within the meaning of Art. 67 § 1 of the Code of Civil Procedure, as well as potential difficulties that may arise at a later stage. In the author’s opinion, the issues in question are not regulated precisely enough by the lawmaker and therefore they may generate doubts in judicial practice.
