GDPR requirements for an facial recognition AI system in the decisions of supervisory authorities relating to Clearview AI

Abstract

The use of facial recognition technology is creating serious threats to the rights and freedom of individuals. The analysis of the decisions of supervisory authorities regarding Clearview AI shows what are the threats arising from the application of an artificial intelligence algorithm for personal data processing by an organization registered outside the EU, which adds photos of people who are in the EU to its knowledge base without the knowledge and consent of those data subjects. The article discusses the decisions of the supervisory authorities from Germany, France, Italy, and Greece regarding Clearview AI and highlights GDPR violations committed in the opinion of these supervisory authorities by Clearview AI.
