Abstract

The article offers a critical analysis of Art. 872 § 1–3 of the Code of Civil Procedure, which introduce mandatory representation by advocates, legal counsellors or patent attorneys in new intellectual property proceedings as compared with the hitherto regulations stipulating compulsory representation by professional attorneys in civil proceedings. The purpose of these considerations is an attempt to resolve interpretative doubts that may arise from the application of the new provisions in practice and to assess the legitimacy of the introduced solution in light of the ratio legis declared by the legislator.
