Abstract

The article examines whether an investor supervision inspector should be regarded as the investor’s representative. To this end, the inspector’s rights, specified in Art. 26 of the Polish Construction Law, are considered. The analysis indicates that the exercise of these rights may have an impact on the performance of the obligations under a construction contract. Consequently, exercising them should be treated as a legal act (transaction). Moreover, those rights are exercised on behalf of the investor and for their benefit. Therefore, an inspector may be considered the investor’s representative within the meaning of Art. 95 § 2 of the Polish Civil Code.
