Impact of the deferment of a performance deadline on the statute of limitation in light of the Supreme Court resolution of 11 September 2020 (III CZP 88/19)

Abstract

The article discusses the above-mentioned Supreme Court resolution in the controversial case of the contractual deferment of the due date of an already mature claim and its impact on the limitation period. The resolution, which correctly favours postponement of the limitation period according to the deferred due date, is of significant value. First, it consolidates certainty of legal transaction which is today undermined by the consequences of divergences in the doctrine and in the Supreme Court jurisdiction. Secondly, because of its form of a resolution as a decision resolving a legal issue (Art. 390 § 1 of the Code of Civil Procedure) it provides arguments which cannot be ignored by a panel of seven judges (III CZP 78/20).
