Abstract

The status of cases involving contractors of construction works and municipalities which often appear on court calendar stirs up numerous controversies. The resolution of the Supreme Court consequently upholds its position that own tasks of municipalities are to be performed as a business activity. The gloss is aimed not only at its critical assessment, but also at determining the legal status of a municipality performing public service tasks.
