Abstract

The gloss is a commentary to the judgment of the Warsaw Court of Appeal of 15 February 2013 (ref. no. VI ACa 1113/12) concerning a consumer credit agreement. The judgment contains two theses. One refers to the banking secret, the other to technical issues related to the disposition of the material provisions of a consumer credit agreement. The consumer credit regulations do not stipulate whether the material provisions should be included in the body of an agreement or might be enclosed in the appendices thereto. The appendices constitute an integral part of an agreement and therefore it is immaterial whether the provisions are laid down in this or any other document. All of those documents comprise a consumer credit agreement.
