The analysis of selected duties of confidentiality connected with control proceedings

Abstract

The article analyses so-called control privileges which include duty of confidentiality of the following: state control authority employees, financial information authorities and their employees as well as of persons performing operations for an organizational unit established for this purpose at the Finance Ministry, trading standards inspectorates and their employees, work standards and safety inspectorates and their employees, food standards and safety inspectorates and their employees, product safety control authorities and their employees, sanitary inspectorates and their employees, as well as competition and consumer protection control authorities and their employees. Each of the abovementioned control confidentialities have been thoroughly analyzed against the same criteria so as to allow a synthetic summary and conclusions to be drawn. The criteria had been elaborated during an earlier phase of the project entitled: “A model for regulating openness and its limitations in a democratic low-governed state” in its part dedicated to the methodology of studying the Polish regulation of the limitations of openness and the related acts of the EU and international law under measure no. 1.03.
