Abstract

In August 2014, the Polish legislator introduced an entitlement for the contracting authorities to require the contractor or subcontractor to employ under a contract of employment persons performing activities under the contract for works or services where this is justified by the subject or nature of these activities. At the same time, introduction of requirement that the specification of the essential terms and conditions of the contract should be accompanied by detailed actions required to perform the contract, the implementation of which may be entrusted only to employees of the contractor or subcontractor. It is also necessary to define in the specification of the essential terms and conditions of the contract the method of documenting the performance of that obligation at the stage of completion of the contract (the right to control by the contracting authority), and the sanctions for non-observance of that requirement. The legal regulation analyzed in the article is aimed primarily at increasing the effectiveness of the Polish labour law.
