Abstract

The purpose of this article is to discuss the allowable limit of different treatment of candidates for law enforcement officers regarding the access to be on duty based on the judgement C-304/21. In its judgement, the Tribunal stated in which situations and based on what circumstances it is allowable to set an upper limit of age while choosing a person to be on duty. It is not true that setting such a limit is prohibited – it may take place in specific and justified circumstances.
