Abstract
In the proceedings for appending an enforcement clause the court examines formal issues which allow to evaluate whether an enforcement order may become enforceable, that is may be a basis for enforcement. Filing of a request for appending an enforcement order, as an act undertaken directly either to assert/determine or satisfy/secure a claim, interrupts the limitation period, the realization of this effect being decided by the very act of the entitled person rather than the later decision of the court. Procedural acts do not invalidate substantive law consequences, unless the legislator directly binds such an effect therewith.
