Abstract

Pursuant to Art. 19(3)(2) of the Act on Court Fees in Civil Cases of 28 July 2005, in case of a complaint a fifth of the fee is charged, unless a special provision provides otherwise. Accordingly, in case of a trial where the value in dispute is in excess of PLN 4,000,000, the fee on a complaint amounts to PLN 40,000, unless a special provision provides otherwise. In its resolution of 11 September 2020, III CZP 86/19, the Supreme Court held that the fee a complaint against a decision regarding rectification of, or refusal to rectify, a ruling should be charged in accordance with Art. 19(3)(2) in conjunction with Art. 13 of the Act on Court Fees in Civil Cases.
