Abstract

The aim of this paper is to present the issue of the existence of legal interest in disputes concerning submitting to enforcement by a notarial deed. This issue is particularly important with regard to the practical use of a court action for confirmation as a legal remedy in this type of disputes. This issue has not been discussed in the doctrine yet, so the authors present the basic aspects concerning the specificity of submitting to enforcement by a notarial deed as compared with other enforcement orders and the concept of legal interest, its substantiation, procedural significance and effects, and then the possibility to bring an action based on Art. 189 of Code of Civil Procedure.
