Abstract

The subject of the article is the contract for the implementation of the architectural design and execution of engineering works (§ 650p–650t BGB) introduced to the German Civil Code (BGB) as part of the reform of the construction contract law on 1.1.2018. The analysis focuses on the concept of the contract for the implementation of the architectural design and its parts: legal nature and types of contracts for architectural design; construction of joint and several liabilities in BGB (§ 421–431); joint and several liability of the architect, structural engineer and building contractor. Given the cooperation between Polish and German construction companies, the topics presented in this article have both comparative and practical significance.
