Abstract

The article discusses the issue of a call for an attempt to settle as a cause for a suspension of the limitation period referred to in Art. 123 § 1.1 of the Civil Code, which was raised by the decision of the Supreme Court of 16 October 2020, IV CSK 107/20. The decision diagnosed the crucial divergences concerning the ability of a call for an attempt to settle to interrupt the limitation period, multiple interruptions of the limitation period in this manner and the court competent to assess this effect. Nevertheless, it does not seem likely that all arguments have been exhausted as regards this issue.
