Abstract

The article reconstructs the grounds (prerequisites) for constitutional accountability under substantive law. Their contents corresponds with the prerequisites of criminal liability for committing a crime. However their source is not found in the Penal Code, but in the Tribunal of State Act. However, the reconstruction leads to a general conclusion that the grounds for constitutional accountability should be described in the Act more fully and specifically.
