Abstract

Under the Act of 4 July 2019 amending the Code of Civil Procedure and certain other acts the legislator introduced to the Polish civil procedure inter alia the institution of dismissal of a claim as clearly unfounded (art. 1911 of the Code of Civil Procedure). The institution may arouse many doubts, though the aim of this article is not its comprehensive discussion. The author has considered only how the prerequisite of „the circumstances of the case” provided for in the abovementioned article should be interpreted.
