Abstract
The article is aimed to determine whether a settlement agreement, as an obligation agreement, is a reciprocal contract, and to discuss the legal consequences of qualifying it as reciprocal or not. It is argued that “reciprocity” is part of the definition of a settlement agreement, but the reciprocal nature of a settlement is debatable. The purpose of this article is to discuss the criteria for recognizing a settlement agreement as a reciprocal contract, and then to determine in this light whether the legal transaction under the settlement agreement is of a reciprocal nature.
