Remarks on changes in Art. 913 § 1 of the Code of Civil Procedure introduced by the Act of 7 April 2017 on the amendment of certain acts of law in order to facilitate debt recovery The article focuses on recent changes of the Code of Civil Procedure introduced by the Act of 7 April 2017 on the amendment of certain acts of lawin order to facilitate debt recovery (Journal of Laws of 2017, item 933) to the extent in which it refers to changes in the institution of disclosure of assets. Although it may appear that the intention of the authors of the amendment was to facilitate debt recovery by creditors by expanding the scope of information provided in the declaration of assets, it is doubtful whether the amendments will meet the expectations. This is due primarily to the fact that the new wording of the regulations gives rise to many interpretational doubts while at the same time it does not solve any of the current problems connected with the functioning of the institution of of the disclosure of assets. The author of the article identifies the main fields in which the new regulation may bring about theoretical and practical legal problems.323
