Abstract

The article discusses the institution of exceeding the limits of necessary defense as provided for in Art. 25 § 2a of the Penal Code. In the first part, the author presents the motivations of the legislator for introducing this institution. Next, reference has been made to the prerequisites for exceeding the limits of necessary defense related to trespassing, as well as its consequences The final part contains conclusions of the discussion.
