Abstract
Under the applicable provisions of the Public Procurement Law, contracting authorities are obliged or entitled to demand that contractors issue a bid bond securing their offer. Given the statutory regulations concerning the forms of bid bonds submitted in public procurement procedures, and the obligation to communicate in public procurement procedures using electronic means of communication, it is worth emphasising the effectiveness of making a bid bond in a non-monetary form in public procurement procedures, in each of the forms of legal action permitted by the generally applicable law.
