Procedural significance of a copy of a document in civil proceedings

Abstract

Pursuant to Article 773 of the Civil Code, a document is a carrier of information allowing its contents to be read. A document is not a uniform concept. It should therefore also include photocopies, and copies identified as secondary documents. Considering a photocopy of a document as a (secondary) document does not automatically confer the status of the same document under the provisions of the Code of Civil Procedure. According to Article 773 of the Civil Code and Article 308 of the Code of Civil Procedure, copies of documents are documents, although in the course of proceedings the court takes evidence from these documents applying only the provisions on evidence from an inspection, and evidence from documents taking into account the specific nature of a certain copy.
