Abstract

The jurisprudence of Polish courts and the National Appeal Chamber is of key importance for the interpretation and correct application of the PPL Act. This publication aims to bring to light current problems in the application of basic public procurement procedures. On the basis of specific facts and case-law, issues concerning the scope of application of the PPL Act, estimating the contract value, dividing the contract into parts, the possibility of using the negotiated procedure, the price query procedure and the negotiated procedure without announcement are all discussed. The publication indicates the most common abuses in this area, and gives reasons for why they occur.
