Abstract

In practice, the obligation of an employer regarding the necessity to indicate a specific reason for the notice of termination of a contract of employment raises significant interpretative problems. The solution is crucial because an incorrect execution of such an obligation may impact the evaluation of accuracy of such a way of notice of termination. The obligation to reveal the reason allows an employee to fight the charges against them, and the labor court may examine the legitimacy and legal compliance of the notice of termination.
