Abstract

The subject of the present article is the judgement of the CJEU in case C-427/21 on the reference for a preliminary ruling filed by Bundesarbeitsgericht (Federal Labour Court, Germany) with a decision of 16 June 2021 which arrived to the CJEU on 14 July 2021 regarding L.D. v. ALB FILS Kliniken GmbH proceedings. The reference for a preliminary ruling concerned the interpretation of Article 1(1)(2) of Directive of the European Parliament and of the Council 2008/104/EC of 19 November 2008 in regard to temporary work. The reference was filed within the proceedings between an employee of L.D. and his former employer ALB FILS Kliniken GmbH regarding permanent provision of work incumbent on L.D. in favour of A Service GmbH as a result of taking up duties by the latter, which L.D. performed in favour of ALB FILS Kliniken.
