Abstract

The purpose of this article is to discuss the issues of legal proceedings regarding pension benefits in case of occurrence of prerequisites included in Article 146 § 1 of the Code of Administrative Procedure based on the judgement of the Constitutional Tribunal of 6 March 2019. Direct consequence of the objective judgement was the resumption of appropriate legal proceedings regarding the granted pension benefits at the instigation of the persons who found themselves in a similar situation, which was the subject of the judgement.
