Abstract

The issue of the multi-track nature of carrying out inspections in the field of personal data protection by competent entities may result in non-uniformity of official positions, which are treated as an official interpretation of the law. This applies to the activities undertaken by the Supreme Audit Office (the supreme state control authority) and the President of the Personal Data Protection Office (the personal data protection supervisory authority). The article describes the legal position of the abovementioned control bodies. It analyses the activity of the Supreme Audit Office as regards inspections of public entities involved in the personal data processing, also from the perspective of statutory competences conferred on the President of the Personal Data Protection Office. In the final part of the study, possible discrepancies have been analysed and possibilities for taking concerted actions by these bodies have been proposed, based on the fundamental principles of the functioning of the state formulated in the Polish Constitution.
