Abstract
The article analyses the legality of ‘consent or pay’ models in the European Union, particularly in the context of large digital platforms. The authors critically assess the European Data Protection Board’s (EDPB) Opinion 08/2024 on the validity of consent in these models. The EDPB’s opinion is controversial as it may expand the definition of consent under the GDPR, negatively impacting data controllers’ capability to set prices and business models. The EDPB suggests that large online platforms should offer free alternatives without behavioural advertising (FAWBA), which could lead to unprofitability of such services. The EDPB’s opinion is criticized for the lack of public consultation and ambiguity, which may lead to inconsistent application of the GDPR across the EU. The authors emphasize that behavioural advertising is legal in the EU, and the EDPB’s opinion may introduce legal uncertainty and undermine the existing legal framework.
