Abstract

In the current legal environment, the behaviours constituting the so-called surrogate motherhood were not generally criminalized. However, due to the significant effects of this phenomenon, the legislator decided to change this situation. Generally, the main point of proposed amendments is criminalization of the behaviour involving transfer of a child to another person in exchange for a pecuniary or personal benefit and concealing this fact from the court in adoption proceedings, and also transfer of a child without any adoption proceedings. In the article, the authors refer to the amendment of the Penal Code, comment on the amendments proposed by the legislator, and also consider if there is any other way of regulating this issue than the one presented by the legislator.
