Abstract
The article presents the effects of obtaining an enforcement title other than a court order (e.g. a notarial act in which a debtor submit themselves to enforcement). The author analyses the recent decision of the Supreme Court according to which the case should be ended for procedural rather than substantive reasons. Rather than dismissing the lawsuit due to the subsequent lack of legal interest in pursuing the claim, the court should terminate the proceedings on account that further proceedings as to the merits of the case are needless.
