Abstract

The judgment of the Court of Justice of 26 March 2020 in combined cases C558/18 and C563/18, Miasto Łowicz v Skarb Państwa – Wojewoda Łódzki et al. is worth noting and analysing not only because it was passed in a case relating to the Polish system of justice and the regime of disciplinary responsibility of judges. The Court specified in it how one of the conditions for admissibility of requests for a preliminary ruling referred to it by national courts under Art. 267 TFUE, i.e. the requirement of the indispensability of a decision of the Court of Justice for passing a verdict by the referring court. The judgment is of considerable importance not only for Polish courts, but also the courts of other Member States. It concerns a significant procedural issue which has been for years an item of doubts and disputes.
