Proper estimation of contract value

Abstract

The article discusses issues related to calculating the value of the subject of a public contract. This topic is important mainly from a practical point of view, but has not yet been properly researched. Meanwhile, issues relating to the commonly referred to process of „estimating the value of the contract” will tend to affect every public procurement procedure, including in the context of various types of control bodies carrying out verifications of the proceedings.

The article points out serious problems and issues related to this topic, concerning statutory regulations, the interpretation of the law and the way in which solutions are applied in practice. Regardless of the identification and analysis of these problematic issues, the article points to proposals for specific organisational and legal solutions that would allow, in the future, the awarding of public contracts to be better organised based on the provisions of the Public Procurement Law of 2019.
