Problems with documenting a clean criminal record by foreign entities

Abstract

The amendment of the Public Procurement Law of 1 January 2021 represents a revolution on the public procurement market, as it is the most significant amendment in nearly eighteen years. The amended act introduces many issues previously unknown to participants in public procurement proceedings. However, the National Appeals Chamber has already faced doubts on the part of participants in the proceedings.

Satisfying the condition of not being excluded from the proceedings on the basis of a certificate from the Polish National Criminal Register has never been a significant problem, but trouble starts when a contractor has to obtain such a document from another country, and the contracting authority has to assess it.
