Abstract

The paper looks at the results of an analysis of the case law and attempts to summarise the conclusions presented so far concerning a wide range of issues raised in justifications of rulings. It looks at issues that may arise in connection with evaluating the contractor’s credibility, including the contractor’s resources. It also touches on matters that will probably require further development in the future, possibly involving the need to formulate further de lege ferenda conclusions if the current regulations prove to be a barrier to proper evaluation.
