Abstract
The main aim of the article is to show the importance of the needs analysis in public procurement proceedings, aimed at correctly describing the subject of the contract in “design and build” public works investments. The needs analysis should evaluate the options for the performance of the contract, estimate the approximate value of the contract, and its component parts, and select the form of the procedure. It should also take into consideration the social and environmental criteria in the execution of the contract as well as a risk assessment. The needs analysis should therefore have a positive impact on increasing the effectiveness of the public procurement process.
