Abstract

The judgement of the CJEU dated 1 March 2018 in case file No C-9/17 (Tirkkonen) concerns the problem of contractor selection as one of the elements making up the concept of public procurement. The CJUE provided a more precise description of the circumstances in which the EU public procurement law does not apply in the case of the concessions system.
