Implementation of EU public procurement law in the United Kingdom

Abstract

In the United Kingdom, provisions of EU directives have been directly implemented in the national legal order, fully adopting categories of contracts and legal solutions put forth by the European legislator. On the other hand, measures of legal protection for the contractors have remained traditional, and implementation of the remedies directives has had little effect on how the British courts proceed – with an exception of regulations relating to the institution of cancellation of contract and alternative penalties.
