Abstract
Hungarian public contract regulations are more detailed than those in Poland. As a matter of fact, each step of the proceedings is regulated. Unlike in the Polish Public Procurement Act, the solutions concerning in-house orders have been directly transposed from Directives. Public order procedures are to be carried out via the e-Public Procurement platform administered by the Public Procurement Office as soon as of 1 February 2017. What is important, in Hungary the exclusion sanction concerns, inter alia, companies with over 25% of capital placed in so-called tax havens. In such cases, the law also allows the contracting authority to terminate the contract even after it has been already signed. The simplified procedure may be chosen by the contracting authority up to the EU thresholds according to the rules laid down in the Act.
