Limit on non-interest credit costs. Observations based on the legal certainty principle

Abstract

On 31 January 2024, the Office of the Polish Financial Supervision Authority (UKNF) issued a position paper indicating that where an entity that is a non-bank payment service provider (e.g. a payment institution) grants a long term consumer credit(acting as a lending institution) and at the same time issues a credit card (as a payment service provider), there is no unity of the lender and card issuer. As a result, the UKNF considered that Art. 36d(2) of the Consumer Credit Act, which introduces an exemption from the limit on non-interest costs of consumer credits, would not apply to such situations. The author takes a critical view by presenting arguments of a linguistic, teleological, logical and constitutional nature.
