Abstract

After the changes made on 28 September 2023, Art. 3671 of the Code of Civil Procedure provides that in the appeal proceedings, as a rule, the court decides in a panel of one judge. A panel of three judges hears the appeal in cases for non-property rights and in those cases for property rights in which the value of the object of appeal in even one of the appeals lodged exceeds one million Polish zlotys.
The new provisions on the composition of the court in appeal proceedings cause particular difficulties in non-contentious proceedings, to which, pursuant to Art. 13 § 2 of the Code of Civil Procedure, Art. 3671 shall apply accordingly.
